1. What these terms cover
These terms explain how you (the business or employer) may use the Yay Monday platform ("we", "us", or "our") to manage job vacancies and receive applications. By creating an account or using the service, you agree to these terms.
2. The Yay Monday service
Yay Monday provides an online platform for collecting and managing job applications. We do not recruit, advertise on external job boards, or take part in employment decisions.
Each job vacancy uses one credit, which allows it to remain live for 30 days. After expiry, the vacancy moves to admin-only mode, meaning you can still view and manage received applications but cannot receive new ones.
3. Credits and payments
- Credits cost £20 each (including VAT, if applicable).
- 1 credit = 1 live vacancy for 30 days.
- Credits are non-refundable, except where purchased in error and at our discretion.
- Credits expire 12 months after purchase.
- Payments are processed via Stripe Checkout. You are responsible for accurate payment details.
4. Your responsibilities
- You are a genuine employer or authorised recruiter.
- You will only post lawful, accurate, and non-discriminatory content and comply with employment and data protection laws.
- You will handle candidate data in line with the UK GDPR and Data Protection Act 2018.
- You remain the Data Controller for any applicant information you receive through the platform.
Recruitment agencies
If you are a recruitment or employment agency, you must comply with all applicable laws and regulations governing your operations, including the Conduct of Employment Agencies and Employment Businesses Regulations 2003. You may only advertise genuine vacancies on behalf of identifiable clients who have authorised you to do so. You must not misrepresent the nature of a vacancy, the identity of the hiring business, or your relationship with that business.
4A. Honest use and fraud prevention
Yay Monday has a zero-tolerance policy for fraudulent or misleading activity.
You must not use the platform for any false, deceptive, or unlawful purpose, including:
- Pretending to represent or act on behalf of another person or organisation.
- Posting a vacancy under a false or misleading business name.
- Posting fake or non-existent vacancies, or roles that do not genuinely exist within your organisation.
- Using any brand, logo, or trademark you are not authorised to use.
- Collecting personal data for any reason other than genuine recruitment for the advertised role.
- Submitting false business information during sign-up or payment.
If we believe an account or vacancy is fraudulent, misleading, or impersonates another organisation:
- The account will be immediately suspended or permanently banned.
- All associated credits, payments, and data will be withheld.
- All applicants connected to the affected vacancy will be notified that the listing may have been fraudulent.
- Where appropriate, we may also notify the legitimate business or organisation being impersonated to help prevent further misuse of their name or reputation.
- Where appropriate, we may report the activity to relevant authorities or share details with affected applicants or law-enforcement bodies.
We reserve the right to take any additional steps needed to protect applicants and maintain platform integrity.
Fraudulent use will not be tolerated under any circumstances.
5. Our responsibilities
- We aim to keep the service reliable but do not guarantee uninterrupted or error-free operation.
- We take reasonable steps to secure and back up data.
- We process applicant data only as instructed by you and not for our own purposes.
- We may occasionally suspend access for maintenance or updates. Wherever possible, this will take place during planned maintenance windows and outside of normal business hours to minimise disruption. For any major updates or scheduled downtime expected to affect normal service for an extended period, we will provide at least one week’s advance notice via email or in-app message.
5A. Fair usage policy
To maintain performance and reliability for all users, Yay Monday operates under a fair usage policy. While each vacancy allows an unlimited number of applications, employers must use the platform reasonably and in good faith.
Excessive or abnormal use - for example, automated or bulk submissions, artificially inflated applicant numbers, or any activity that places disproportionate load on the platform may be restricted or suspended at our discretion to protect service quality.
We will always attempt to contact the account holder before taking any action, except in urgent cases where immediate steps are required to maintain system integrity.
6. Account security
You are responsible for keeping your login details secure. If you suspect unauthorised access, notify us immediately at [email protected].
7. Data protection
- You are the Data Controller for applicant data; Yay Monday is the Data Processor.
- We comply with the UK GDPR and Data Protection Act 2018.
- Applicant data is automatically deleted after your selected retention period (default: six months after a vacancy closes), unless you delete it sooner.

8. Intellectual property
All rights in the Yay Monday software, website, and branding belong to Yay Monday. You may not copy, resell, or reverse-engineer any part of the service.
9. Limitation of liability
- We are not liable for loss of profits, revenue, data, or business opportunities, or any indirect, special, or consequential loss.
- Our total liability for any direct loss is limited to the total amount you paid to us in the 12 months before the issue arose.
10. Ending your use of the service
You may stop using Yay Monday at any time. We may suspend or close your account if you breach these terms, misuse the platform, or act unlawfully. If your account is closed, your data will be retained for 30 days before permanent deletion.
11. Changes to these terms
We may update these terms occasionally. We will post updates on our website, and continued use of the platform means you accept the revised terms.
12. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
